Council has agreed its mandate – Parliament's committee vote is pending
EU Inc remains a Commission proposal under the ordinary legislative procedure. On October 23, 2026, member states' ambassadors (Coreper) agreed the Council's mandate for negotiations with the European Parliament, based on the Irish Presidency's third compromise text. Parliament has no mandate yet: the Legal Affairs (JURI) Committee vote on rapporteur René Repasi's report, planned for October 8, was postponed after the rapporteurs failed to agree compromise amendments on employee participation, according to press reports. Parliament's official dossier still records the file as awaiting a committee decision.
The Council mandate and the 246 amendments in the rapporteur's draft PE790.143v02-00 are negotiating positions – not adopted law. The Council mandate would give Member States 21 months instead of 12 to apply the rules.
Next: a rescheduled JURI committee vote, for which no official agenda date is published yet. Trilogue negotiations between Parliament and Council can start only once Parliament has its own mandate. The European Council has asked for negotiations to conclude by the end of 2026. No official registration date has been fixed.

Council agrees its negotiating mandate on EU Inc
Member states' ambassadors (Coreper) agreed the Council's mandate for negotiations with the European Parliament, based on the Irish Presidency's third compromise text of October 16. The mandate keeps a fast-track formation route within 48 hours (excluding weekends and public holidays) at a maximum cost of EUR 100, lets Member States delay or refuse registration on anti-money-laundering and criminal grounds, adds an optional mechanism for companies that exceed employee-participation thresholds in another Member State, limits EU-ESO stock options to small mid-caps, removes the insolvency chapter and gives Member States 21 months instead of 12 to apply the Regulation. Trilogues can start once Parliament has its own mandate.
