EU Inc remains a Commission proposal under the ordinary legislative procedure. The JURI Committee is considering rapporteur René Repasi's draft report on July 15–16, 2026, while the Council Working Party on Company Law continues its technical review. The official Parliament dossier still records the file as awaiting a committee decision.
The 246 amendments in PE790.143v02-00 are the rapporteur's draft—not the European Parliament's adopted position and not current law.

Council of the European Union→EU Inc is the name of an optional pan-European company form proposed by the European Commission on March 18, 2026 within the wider 28th-regime approach. If adopted, it would create a common corporate-law framework recognised in all 27 member states. Tax, employment, licensing, branch and other local registrations could still apply.
European founders currently navigate different national company-law systems when expanding. The proposal aims to offer one optional corporate framework with digital procedures and common templates. It could reduce company-law friction, but it would not replace national tax, employment or sector-specific obligations.

There is no official registration date. Parliament and the Council must first adopt a final text. Under Article 109 of the Commission proposal, the Regulation would apply 12 months after entry into force.
The Commission proposal caps the fee at 100 EUR only for the fast-track route through the central EU interface using the EU form and templates. Other costs may remain; the proposal sets no statutory minimum capital.
If the Regulation is adopted and starts to apply, the EU Inc form would be available in all 27 Member States. It is not available in any country today.
The proposal removes a routine in-person appearance, but preventive control may still be administrative, judicial or notarial. Formation is designed to be online, with an exceptional physical-presence check in limited cases.
Under Article 62 of the Commission proposal there is no statutory minimum capital; the articles may state EUR 0. This is a proposed rule, not current law. A German GmbH generally has EUR 25,000 stated capital, while other national forms have different requirements.
COM(2026) 321 is under the ordinary legislative procedure as file 2026/0074(COD). Parliament and the Council are examining the Commission proposal; it is not law, and committee drafts are not final institutional positions.
